The presentation will explain how bankruptcy works, focusing on the big picture rather than technical details. We intend to cover the common types of bankruptcy cases, the automatic stay and bankruptcy discharge and their exceptions, what is “property of the estate,” the concurrent jurisdiction of bankruptcy and state courts, and the availability of federal and state exemptions in bankruptcy cases. We also intend to give litigation tips to state court practitioners representing creditors on how to optimize the potential use of issue preclusion in bankruptcy cases. Time permitting, we might briefly cover fraudulent and preferential transfers.
